Terms Of Service

These Terms and Conditions ("Terms") govern your use of our online ticketing platform and services (the "Service"). By accessing or using QuikTix, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Service. Our goal is to provide a seamless and cost-effective way for event organizers to sell tickets and for attendees to purchase them.

Introduction

By agreeing to the Terms, you also acknowledge you read and agree to the Privacy Policy and the Cookie Statements applicable to the Service’s users. You further acknowledge that all interactions with the Service will be subject to the regulation of our other policies, including but not limited to our Trademark & Copyright Policy, Chargeback Policy, Promotions and Giveaways Policy, Event Postponements and Cancellation Policy, Event Organizer Code of Conduct, Event Attendee Code of Conduct, and QuikTix Promoter Code of Conduct.

Definitions

"Account" means a registered account created by an Event Organizer on QuikTix.

"Attendee" refers to the users who purchase tickets for events available through QuikTix.

"Content" refers to all information, text, images, and other materials available on QuikTix.

"Event" refers to any assembly, meeting, or gathering, organized and executed by an Event Organizer, for which Tickets are made available for procurement by Attendees via the QuikTix platform.

"Event Organizer" refers to individuals or entities hosting events and selling tickets through QuikTix.

"Service" refers to the online platform, including the QuikTix website and mobile applications, along with any associated services provided by QuikTix.

"Ticket" represents the admission passes that become available for public purchase once an event is listed on QuikTix.

"User" denotes any individual or entity that utilizes the Service, encompassing both Event Organizers and Attendees.

"We", "Us", or "Our" applies to QuikTix Inc, including its representatives.

"You" or "Your" addresses the Users who are reviewing this document to understand and agree to the Terms of Service.

"QuikTix" refers to the platform provided by QuikTix, Inc., including its website, mobile applications, and services.

Organizer Accounts

Account Creation and Management

To use certain features of QuikTix, such as creating and managing events, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Note that account creation is not required for purchasing tickets to existing events.

You agree to register an account only if you are over the age of 18.

Account Responsibility

You are responsible for safeguarding your password and for any activities or actions under your account. You are also responsible for ensuring that you only connect Stripe accounts that you own or are authorized to handle on behalf of the event organizing company. QuikTix is not liable for any loss or damage arising from your failure to comply with these requirements.

Account Security

You agree to notify QuikTix immediately of any unauthorized use of your account or any other breach of security. QuikTix reserves the right to terminate or suspend your account at any time if we believe you have violated these Terms.

Services Provided

QuikTix offers a variety of services to enhance the event ticketing experience for both Event Organizers and Attendees. Our services include:

  • Event Ticket Web Page Creation & Management: Event Organizers can set up and manage Events by detailing event information, configuring Ticket types, and setting prices.
  • Online Ticket Sales: Users can purchase Tickets securely via our platform. We process payments through reliable credit card transactions to ensure smooth operations using the help of our third-party payment processing partner, Stripe.
  • QR Code Ticketing: Tickets issued can come equipped with a unique QR code when used in Ticket Mode, facilitating easy and secure entry to Events.
  • Attendee Check-In: Event Organizers can use our mobile application or organizer dashboard on our website to scan QR codes for Attendee verification, with access to a searchable list of ticket holders.
  • Customer Support: We provide comprehensive support to all Users, ensuring a positive experience with QuikTix. We strive to respond to all customer support email inquiries promptly. However, please be aware that in periods of high demand, our response may take up to four business days.

Event Promotion

QuikTix provides the platform for listing and selling tickets to your Events. However, the promotion and marketing of these Events are solely the responsibility of the Event Organizer. You understand and agree that QuikTix reserves the right to, but is not obligated to undertake any promotional activities on behalf of Event Organizers and is not responsible for the success or attendance of the Events.

Fees and Payments

Pricing and Fees

By using QuikTix, you agree to pay the fees associated with the Services as described during the event creation process. Our fee structure is composed of a flat fee of $0.70 per ticket sold + 0.5% of each transaction, excluding payment processing fees incurred via Stripe. The QuikTix fee is deducted from the listed ticket price, rather than being added to it as is common practice in the industry.

Payment Methods

We use Stripe as our payment handling service, which allows us to accept various payment methods offered by Stripe. All transactions are processed securely to ensure the protection of your payment information.

Refund and Cancellation Policies

Refunds and cancellations are subject to the policies set by the Event Organizer. QuikTix will facilitate refunds according to these policies but is not responsible for setting or enforcing them. Users must contact the Event Organizer for any refund or cancellation requests. Ticket refunds do not include Stripe and QuikTix processing fees.

By purchasing tickets through QuikTix, you agree to the terms of service and refund policies of the respective Event Organizer. Any disputes regarding payments should be directed to our customer support team for assistance.

Payment Processing

QuikTix uses Stripe to handle financial transactions. By using our Service, you agree to the terms and conditions of Stripe. QuikTix is not liable for any issues arising from payment processing, including but not limited to transaction errors, delays, or fraud. Our third-party payment processing service allows for refunds if reimbursements are required.

Disputed Transactions

Disputes regarding transactions can be handled via Stripe. Event Organizers are responsible for processing refunds in accordance with their policies. Please note that QuikTix fees are not refunded, even if a transaction is disputed or reversed. If you have any issues with a transaction, please contact our support team for assistance.

User Obligations

By using QuikTix, you agree to comply with the following obligations:

Compliance with Laws

You must comply with all applicable local, provincial, and national laws and regulations while using our Service.

Accurate Information

You agree to provide accurate, current, and complete information during the registration process and while using the Service. You are responsible for maintaining the accuracy of this information.

Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose or to promote illegal activities.
  • Engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
  • Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service.
  • Use the Service to distribute unsolicited promotional or commercial content (spam).
  • Upload any content (written, photo/video media, or links) towards any content that could be deemed offensive, insensitive, upsetting, intended to disgust, in exceptionally poor taste, or just plain creepy.

Event Conduct

Event Organizers are responsible for ensuring that their events comply with all applicable laws and regulations. You agree not to host or promote events that are illegal, harmful, or violate the rights of others.

Content Ownership and Use

You retain ownership of any Content you submit through the Service. However, by submitting Content, you grant QuikTix a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Content for the purposes of operating and promoting the Service.

Security

You are responsible for maintaining the security of your Account and are fully responsible for all activities that occur under your Account. You agree to notify QuikTix immediately of any unauthorized use of your Account or any other breach of security.

Cooperation with Investigations

You agree to cooperate with QuikTix in any investigation into potential or alleged violations of these Terms or any applicable law.

By adhering to these obligations, you help maintain a safe and trustworthy environment for all Users on QuikTix.

Intellectual Property

Ownership of Content

All Content provided on the QuikTix platform, including but not limited to text, images, logos, and software, is the property of QuikTix or its licensors. You may not use, reproduce, or distribute any Content without explicit permission from QuikTix.

User-Generated Content Rights

Users retain ownership of any Content they submit through the Service. By submitting Content, you grant QuikTix a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Content for the purposes of operating and promoting the Service. You represent and warrant that you have the necessary rights to grant this license.

Privacy Policy

Data Collection

QuikTix collects personal information from Users to provide and improve our Services. This includes information provided during account creation, event registration, and ticket purchases.

Data Usage and Sharing

We use collected data to facilitate transactions, provide customer support, and improve our platform. We may share data with third-party service providers, such as Stripe, for payment processing. We do not sell personal information to third parties.

User Rights and Data Protection

Users have the right to access, modify, or delete their personal information stored on QuikTix. We employ industry-standard security measures to protect your data from unauthorized access and breaches.

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.

Arbitration or Mediation Clauses

Any disputes arising out of or related to these Terms or the use of the Service shall be resolved through binding arbitration or mediation in Ontario, Canada, as chosen by QuikTix. The decision of the arbitrator or mediator shall be final and binding.

Limitation of Liability

Disclaimer of Warranties

QuikTix provides the Service on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. QuikTix disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages

To the maximum extent permitted by law, QuikTix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (v) any errors or omissions in any Content; and (vi) any loss or damage incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available through the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not QuikTix has been informed of the possibility of such damage.

Termination

Conditions for Terminating Services or Accounts

QuikTix reserves the right to terminate or suspend your Account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach any terms of this Agreement.

Effects of Termination

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your Account, you may do so by discontinuing the use of the Service and deleting your Account.

Modifications of Terms

Right to Change Terms

QuikTix reserves the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website. It is your responsibility to review these Terms periodically for changes.

Notification Procedures

We will notify you of any material changes to these Terms through the email address provided in your Account or by placing a prominent notice on our website. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

Governing Law

These Terms and any disputes arising out of or related to these Terms or the use of the Service are governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.
